ALLEN, Circuit Judge.

This appeal is taken from a judgment rendered on a verdict in favor of the ap-pellee, who brought an action under the Federal Employers’ Liability Act, 45 U.S. C.A. § 51 et seq., to recover damages for the death of her husband, Samuel Ilillen, who was injured while working as a switch-man in appellant’s terminal railroad yards at the Fort Street Union Depot in Detroit, Michigan. Liability was asserted to arise out of the alleged violation by appellant of Sections 4 and 8, Title 45 U.S.C., 45 U.S.C. A. §§ 4, 8, (the Federal Safety Appliance Act), which require all cars…
