The defendants in error commenced this action in the district court November 22, 1909, to recover of the plaintiff in error for the death of Martin Y. Milam, who died as the result of injuries inificted by one of plaintiff in error’s street-oars July 27, 1909, and it was alleged by plaintiff below that such death was the result of negligence on the part of the railway company’s employees and servants in change of said car.
