The Children’s" Aid Society of Allegheny County (hereinafter termed. Society) filed its petition for a writ of habeas corpus,fo secure custody of Betty Jean Tuttle, age 4, from W. Bussell Gard and Helen Gard, appellants and foster parents, averring inter alia its appointment as guardian by the Orphans’ Court of Allegheny County; an agreement between it and appellants providing for the return of the child to it upon request; that the Society has secured an adoptive home for its ward; and that the welfare of the ward would be best secured by allowance of the writ.
