The allegations of the first count or cause of action of the plaintiffs’ complaint, so far as here material, are substantially *491as follows: That P. L. Peterson on June 15, 1891, applied to the-defendants for a loan of $4,000, which they made to him, and, in consideration therefor, received from him his promissory note, dated on that day, for that sum, due six months after date, payable-to Bear Valley Bank, or order, with interest at the rate of 8 percent. per annum.
