EVANS, District Judge.

The plaintiff, a citizen of Kentucky, was a brakeman or switchman employed by the Illinois Central Railroad Company, and was hurt, while coupling cars for that company, at Paducah, Ky. This action to recover damages therefor was brought in the state court by the plaintiff against the railroad company, W. R. Carroll, and E. P. Smith. The railroad company is a citizen of Illinois. W.
