delivered the opinion of the court:

This is an appeal by plaintiff Janet Soedler from the order of the Circuit Court of La Salle County granting defendant Melvin Soedler’s motion to dismiss her personal injury tort action against him. The court dismissed the action on the basis of section 1 of “An Act to revise the law in relation to husband and wife” (Ill. Rev. Stat. 1979, ch. 40, par. 1001, formerly 111. Rev. Stat. 1977, ch. 68, par. 1), which states in pertinent part:
