The subject of this controversy is an application of appellant to the building department of the city of Omaha for a certificate of occupancy authorizing him to improve real estate in the 1st- residence district as designated by the zoning ordinance of the city for residential purposes. The description of the land involved is the north 169 feet of Block 10, Ridgewood Addition, in Douglas County. It is outside of but within 3 miles of the city and is unimproved. An ordinance of the city prohibits vacant land within the reach of the ordinance to be occupied or used or a building to be erected…
