The plaintiffs in this case represent a class of borrowers. Each class member borrowed money pursuant to ninety-day unsecured loans from American National Bank (“ANB” or “the bank”) during the relevant time period. The loan agreements provided that the borrowers were to repay the funds at the prime rate plus an additional percentage amount that varied from loan to loan (e.g., prime plus one percent).
