In this personal injury action, defendant Cracker Barrel Old Country Store, Inc. (“Cracker Barrel”), appeals from the trial court’s order denying its motion to dismiss plaintiff Gail Robinson’s renewed complaint. Cracker Barrel argues, inter alia, that the court erred in rejecting its argument that Robinson’s two prior voluntary dismissals of this action resulted in an adjudication on the merits under OCGA § 9-11-41 (a) (3), thereby barring her from refiling the complaint a third time as a renewal action.
