Petitioner has filed this petition for writ of habeas corpus, in forma pauperis, pursuant to 28 U.S.C. § 2254. Issues *799have been joined by respondent upon the filing of answer and motion to dismiss.

Petitioner is at present incarcerated in the State’s Prison in Jackson, North Carolina.
