This is an action for damages, filed in the Circuit Court of the City of St. Louis, in which William Dees, as plaintiff, alleges the negligence of defendant as the cause of personal injuries suffered by him while employed by defendant. The trial resulted in a verdict and judgment for plaintiff in the sum of $17,500. The trial court held that the amount of damages awarded by the jury was excessive, but overruled the defendant's motion for a new trial upon the condition that plaintiff remit the sum of $8500.
