Reversing.

The appeal is from a judgment of the Harlan Circuit Court in the sum of Five Thousand Dollars ($5,000) in favor of appellee for the death of his wife, who was killed when struck by a passenger train at about 1:00 o’clock P.M. October 21, 1946, at a public crossing over appellant’s track within the corporate limits of Wallins, a city of the sixth class.
