The plaintiff and appellee moves to dismiss this appeal on the following grounds :
1st. That the charter of the defendant company, the appellant, expired by law and by its own limitation, on the 31st day of March, 1879, the same having been restricted to twenty-five years duration, and being dated the 31st of March, 1851, as shown by the exhibit annexed to the motion;
