On the afternoon of December 13, 1928, the plaintiff Lampros Touris, a lad five and a half years of age, was crossing Rhode Island street in the city of Buffalo, when he was struck and injured by an automobile, owned by the defendant and driven by one of its servants. Actions have been commenced by the boy and his father to recover the damages to which they claim to be entitled by reason of this accident. The cases were tried together. After the jury had reported a disagreement, the court, upon motion of defendant’s counsel, directed a verdict in favor of the defendant in each case.…
