DECISION AND ORDER
KAHN, District Judge.
Plaintiff brings this action pursuant to Bivens v. Six Unknown Named Agents of the Fed. Bureau of Narcotics, 403 U.S. 388, 91 S.Ct. 1999, 29 L.Ed.2d 619 (1971), alleging violations of his rights under the Fifth and Eighth Amendments to the United States Constitution. Plaintiff seeks monetary relief and a declaration that his rights were violated. Presently pending is Defendants’ motion to dismiss the complaint.
