Appeal from Polio District Court. — Thomas J. Gutiirie, Judge. Action at law, to recover upon a policy of accident insurance. There ivas a judgment for plaintiff, and defendant appeals.

l. insurance : ac-juries: insurer as final arbiter. It is conceded of record that the plaintiff’s intestate died March 14, 1916; that his death resulted from a gunshot wound, without any other concurring or contributing cause; and that, at the time of his death, he held a valid policy of accident ingurance in the defendant association.
