This is an appeal from the Martin Circuit Court wherein an oral trust agreement between plaintiff-appellee, Jerry Horn (hereinafter referred to as Jerry), and defend*320ant-appellant, Luther Horn (hereinafter referred to as Luther) was found to be valid and enforceable.
