Plaintiff, an insurance adjuster, adjusted the loss of the Dreyfous fire for the Prussian National Insurance Company, the Commerce Insurance Company, the Balkan and Bulgaria Insurance Company, represented by E. T. Marshall & Co., the Queen City Insurance Company, and the Eastern Fire Insurance Company. The adjustment was conditional. It fixed the loss at $240,000, but on the condition that, in *367the event the adjustment for the other insurance companies interested in the fire- was at a less figure, the insured should reimburse the above-named companies the difference between the two…
