The defendants were tried jointly on two bills of indictment, one charging conspiracy to cheat and defraud J. Harold Van Sciver “by means of procuring the making and signing, and of uttering and publish ing as true, a large number of fraudulent written instruments consisting of divers promissory notes.” purported to have been given by the makers as consideration for the sale and delivery of oil burners.
