¶1 —The Department of Labor and Industries (Department) cited Potelco Inc. for violating three Washington Industrial Safety and Health Act of 1973 (WISHA)1 safety regulations related to flagging operations at two work sites. The Board of Industrial Insurance Appeals (Board) affirmed the Department’s citations, and Potelco appeals. Potelco argues that the Board lacked substantial evidence to support its findings that flaggers at Potelco’s Bremerton work site violated WAC 296-155-305(9)(b) and flaggers at Potelco’s Bremerton and Bainbridge Island work sites violated WAC 296-155-305(8)(a).…
