Ritz, President:

The plaintiff brought this suit to recover the indemnity provided in a policy of insurance' issued by the' defendant upon the life of her husband Harry Goodbar. To review a judgment in her favor for the amount of said indemnity this writ of error is prosecuted.

On the first day of' December, 1913, according to the plaintiff’s contention, and on the first day of January, 1914, ac*223cording to the contention of the defendant, Harry Goodbar applied to an agent of the defendant for a policy of life insurance in the sum of three thousand dollars.
