IN THIS ACTION, the Plaintiff, Gates Energy Products, Inc. . (hereinafter “Gates”), seeks declaratory and injunctive relief, compensatory damages, and punitive damages in three allegedly distinct counts in Plaintiff’s Amended Complaint. In Count I, Gates seeks declaratory relief, punitive damages and compensatory damages to remedy Defendants’ alleged infringement of Gates’ United States Letters Patent No. 3,862,861 (hereinafter “the ‘861 patent”).
