By Memorandum & Order dated October 3, 2008, this court granted Plaintiffs’ Motion to Remand this action to state court. Kudlek v. Sunoco, Inc. (R & M) (“Kudlek I”), 581 F.Supp.2d 413 (E.D.N.Y. 2008). Pursuant to Rule 59(e) of the Federal Rules of Civil Procedure, Defendant Sunoco, Inc. (R & M) (“Sunoco”) timely filed a Motion for Reconsideration, currently before the court. (Docket Entry #23.)
