Appeal from that part of an order of the Supreme Court (Dowd, J.), entered November 15, 1999 in Otsego County, which denied plaintiff’s cross motion to dismiss defendants’ counterclaims for failure to state a cause of action.
Plaintiff was employed by defendant Oneonta City School District (hereinafter the District), pursuant to a written agreement with a renewal clause, as Superintendent for a term beginning July 1,1993 and ending June 30,1997.
