GUTIERREZ, Chief Judge.

Ernesto Gutierrez-Medina appeals from the district court’s judgment summarily dismissing his petition for post-conviction relief. For the reasons set forth below, we affirm.

FACTS AND PROCEDURE

In 1995, Gutierrez-Medina, a citizen of Mexico and legal permanent resident of the United States, was arrested for delivery of a controlled substance.
