Appeal by defendant from a judgment of the Supreme Court, Queens County (Di Tucci, J.), rendered January 30, 1984, convicting him of attempted burglary in the second degree, possession of burglar’s tools and criminal trespass in the third degree, upon a jury verdict, and imposing sentence.
Judgment modified, on the law, by vacating the sentence. As so modified, judgment affirmed and matter remitted to the Supreme Court, Queens County, for resentencing.
