David Cady brought an action under 42 U.S.C. § 1983 against the City of Chicago, the commissioner of the City’s Department of Aviation, the Archdiocese of Chicago and the chaplain of the O’Hare Airport Chapel, Reverend John J. Jamnieky, for violations of his First and Fourteenth Amendment rights. He alleged that the defendants imposed unconstitutional prior restraints on his access to a public forum, a literature rack located outside the O’Hare Airport Chapel.
