This is a proceeding to assess the stockholders of the Hanover State Bank, in liquidation under the direction of the commissioner of banks, upon their constitutional double liability. The court levied an assessment of 100 per cent. The defendants appealing appeared specially at the place set for the hearing of the petition for an assessment and objected to the jurisdiction of the court upon the ground that the hearing was not within the period of 60 days from the date thereof, as required by L. 1925, p. 323, c. 273, and upon the further ground that the notice did not prescribe, in a general…
