MEMORANDUM OPINION

RICE, United States Magistrate Judge.

Wachovia Bank, N.A. (“Wachovia”) claims it owns $1,903,600 held in various accounts of its customer, defendant Payment Processing Center, LLC (“PPC”). The funds are included in approximately $10 million restrained by the Hon. John R. Padova, U.S. District Court Judge, based on the government’s claim that PPC engaged in fraud as a processor of unlawful telemarketing payments.
