CONNELL, District Judge.

Plaintiff instituted this action under the Declaratory Judgment Act, 28 U.S.C. § 2201, petitioning this Court to adjudge that (1) the plaintiff is an insured under the policy of automobile insurance issued to one Norman V. Grund by the defendant, and is entitled to all the protection afforded by that policy; (2) defendant is obliged to defend plaintiff against any claim arising oijt of the accident described below, and to pay all sums which plaintiff may become legally obligated to pay as a result of this same accident; (3) defendant wrongfully breached its contract of…
