This is a partition suit brought in the district court of the territory of Oklahoma, within and for Pottawatomie county, on September 11, 1905, by Clara E. Rose and others, as plaintiffs, against John P. Kin-ard, as defendant. The petition alleged that the plaintiffs and defendant were the children and sole heirs of Armétta J. ICinard, deceased, who died seised of the land in the petition described, and prayed for a partition of said land, and that in case partition could not be had in kind, that the same be sold and the proceeds of the sale be divided between the plaintiffs and said…
