Early in 1927 Patrick H. Carroll had in course of construction in Waterbury a large apartment house. Because of lack of capital it became impossible for him to complete the building. Thereupon a meeting was held, at which he, the representatives of a large number of creditors having mechanics’ liens or rights of lien upon the property, and the defendant, who is a practicing attorney in Waterbury, were present.
