It appears from tlie record in this case, that on January 13th, 1892, E. W. Marsh and others filed their equitable petition in Eulton superior court, against the. Atlanta and Elorida Railroad Company. It was alleged in the petition, that the defendant was insolvent and unable to pay its debts, that petitioners were unsecured •creditors, that since the maturity of the debts owing to petitioners respectively,payment had been demanded and *737refused, that the indebtedness was contracted in the conduct of the defendant’s legitimate business, etc. Among ■other things, petitioner prayed…
