This declaration avers the defendant to be a common carrier of goods and chattels for hire, in and by a certain railroad or railroads from the city of Chicago to the city of St. Louis. That at defendant’s request, plaintiff below caused to be delivered to it certain goods and chattels, (enumerated in the declaration, and as they are described in the deposition of the plaintiff and his wife,) the property of the plaintiff, and of the value of $500, to be carried by the said railroad or railroads from Chicago to St. Louis; that defendant, in consideration of a reward, etc., undertook and…

The appellant makes the following points on this record:
“First. The deposition of the plaintiff and his wife was improperly admitted on the trial.
“ Second. The testimony of the plaintiff and his wife was improperly admitted as evidence of the delivery of the trunk alleged to have been lost, and of the value of its contents.
“ Third. Bank bills carried in a passenger’s trunk are not ‘baggage,’—and without notice to the carrier, and in the absence of fraud, the carrier will not be liable, in case of loss, for their value.
