ORDER

JOYCE HENS GREEN, District Judge.

On December 14, 1990, Michael L. Davis was acquitted of a federal bribery charge.1 The jury was unable to reach unanimity on the other count and a mistrial was therefore declared. The defendant has moved to dismiss the remaining local count in the indictment (Count One) on the ground that the Court should not exercise its discretion to retain jurisdiction over this count now that the federal charge no longer exists. The Government urges the Court to retain jurisdiction and retry this defendant in this Court on the local charge. For the following reasons,…
