This appeal is from a decision of the Court of Appeals which affirmed a sum*182mary judgment in a declaratory judgment action which upheld an annexation ordinance adopted by the City of Hillview.

The issue presented is whether the Court of Appeals properly applied the holding in Merritt v. City of Campbellsville, Ky. App., 678 S.W.2d 788 (1984).
