On February 20, 1914, R. A. Gross filed a claim against the estate of Thomas H. Thornson in the probate court of LaSalle county, being a promissory note for $2000 executed by Thornson to the claimant, dated September 8, 1913, and due on March 30, 1914. The claimant appealed from a judgment disallowing the claim to the circuit court, where there was a jury trial. Each party moved for a directed verdict, and the court having overruled the claimant’s motion, directed a verdict for the defendant and rendered judgment against the claimant for costs.
