— Respondent brought this suit against appellant to recover damages for personal injuries alleged to have been sustained while he was a passenger upon one of appellant’s cable cars running upon James street in Seattle. A trial was had before a jury, resulting in a verdict of $3,500 in favor of respondent. Appellant interposed a motion for new trial, and the same came on regularly for hearing on the 10th day of February, 1902.
