This action in ejectment was instituted October 13, 1919, by the appellants as tbe sole beirs of W. W. Settle, wbo died intestate in 1889. In tbeir petition appellants allege that as such heirs they were the owners by inheritance of a certain tract of land in Jackson county, Kentucky, title to which was in their ancestor at the time ol his death, but which was then being unlawfully held and claimed by the named defendants.
