Error to the Court of Civil Appeals for the First District, in an appeal from Houston County. Kennedy and wife sued the lumber company for the recovery of land and obtained judgment. It was affirmed on appeal by defendant, who thereupon obtained writ of error.

Kennedy and wife instituted this suit to recover of the plaintiffs in error 160 acres of land, being a part of survey No. 56 in the name of the International & Great Northern Railroad Company, situated in Houston County. We will eliminate from this statement all that does not bear upon the issue of law that is presented to us for decision. The lumber company had the title to the land unless Kennedy acquired title thereto by limitation of ten years.
