delivered the Opinion of the Court.

Appellant, H. D. Warren, was tried on an indictment charging him with the murder of one George C. Mcllroy and found guilty of manslaughter. A sentence of five years was imposed.

The facts leading up to the homicide may be briefly summarized as follows: On May 14, 1944, Mcllroy, two other men, and five women were returning North from a stay at Melbourne, Florida.
