Bobby McCoy sued Southern Bell Telephone and Telegraph Company, an unknown employee truck driver, and John Doe to recover damages resulting from an automobile collision. Pursuant to OCGA § 33-7-11, State Farm Fire and Casualty Insurance Company was served as McCoy’s uninsured motorist insurance policy carrier. After preliminary discovery was held, State Farm moved for summary judgment which was granted by the trial court on the ground that no question of fact remained as to the identity of the proper defendant.
