This case is before us upon a question of law certified by ■the Judges of the United States Circuit Court of Appeals for the Sixth Circuit under the sixth section of the act of March 3, 1891, c. 517, 26 Stat. 826.

It appears from the statement accompanying the certificate that on the 18th day of October, 1891, John A. Hervey, a citizen of Ohio residing in Hancock County in that State, was a passenger ón a train of the Baltimore and Ohio Railroad Company between- Chicago, Illinois, and Fostoria, Ohio.
