Declaratory judgment plaintiff Lois Sportswear, U.S.A., Inc. (“Lois”) and defendant Textiles Y. Confecciones Europeas, S.A. (“Textiles”) have both moved this court in this consolidated action for summary judgment pursuant to Fed.R.Civ.P. 56 granting the declaratory relief sought by Lois against defendant Levi Strauss & Company (“Levi”) in 82 Civ. 8326 and dismissing the claims of Levi against Textiles in the related action, 83 Civ. 4338.
