Introduction
Plaintiffs, The Elizabeth Taylor Cosmetics Company and Chesebrough-Ponds, Inc. (collectively “Taylor”) commenced this action against defendants Annick Goutal S.A. R.L. and Annick Goutal, Inc. (collectively “Goutal”) seeking a declaratory judgment pursuant to 28 U.S.C. §§ 2201 and 2202 that the use by Taylor of the mark “Elizabeth Taylor’s Passion” does not constitute unfair competition or infringe any mark claimed by Goutal including the Annick Goutal product line “Passion.” Goutal has counterclaimed for a preliminary injunction pursuant to Rule 65…
