Brower, J., This action involves a suit for damages for personal injuries sustained in the collision of an automobile driven by the appellant William H. Gottsch, defendant in the ¡district 'court, and' a' taxicab operated by the appellee and plaintiff Donald Biggs. .The Safeway Cab.Company was made a party defendant because of rights of subrogation only.
In this opinion Biggs will be referred to as plaintiff and Gottsch as defendant as they were designated in the district court.
Trial was had to a jury which resulted in a verdict and judgment for the defendant dismissing the plaintiff’s action.…
