BICKLEY, Justice.

This is a suit by appellees (plaintiffs) upon a written contract which appellant admitted was the contract between parties.

After a jury trial, judgment was rendered for plaintiffs upon the verdict. Defendant (appellant) appealed and filed a prsecipe for a partial record under the provisions of section 4 of rule XI of the Rules of Appellate Procedure, which prsecipe stated that it desires a review of the alleged error of the trial court in refusing defendant’s request for certain instructions.
