Appeal from a judgment of the Supreme Court, Erie County (Timothy J. Drury, J.), entered June 15, 2007 in a personal injury action. The judgment, among other things, dismissed the complaint.

It is hereby ordered that the judgment so appealed from is unanimously affirmed without costs.
