Appeal from an order of the Supreme Court, Monroe County (William P Polito, J.), entered December 20, 2004 in a personal injury action. The order granted plaintiffs motion for a directed verdict on the issue of significant disfigurement (see Insurance Law § 5102 [d]).

It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law without costs and the motion is denied.
