This is an original proceeding instituted by the petitioner, Burnice Brummitt, in which he seeks a writ of mandamus directed to the respondent, R. W. Higgins, district judge of Pittsburg county, ordering the said respondent to dismiss a criminal action filed against the petitioner in the district court of Pittsburg county, for the reason that several terms of court have passed since an information was filed against petitioner, charging him with the crime of murder, and that petitioner lias been denied his right to a speedy trial as guaranteed by the Constitution and statutes of the State of…
